He then is found in Rutledge's Mounted Rifles and Horse Artillery.On 30 March 1863 by order of Brig. Gen. W.S. Walker at Pocatalico, SC he was transferred to Co. D 46th N.C. Infantry. He was elected to 1st Lieut of that company on the same day. Nov. 4 1864 he is on a roster of the 46th Reg. NC Vol's , in Cook's Brigade, Heath's Division , Hills Corp, Army of Northern Virginia organized 4 April 1864. He is paroled with his unit near Goldsboro, NC May 1865.

He was wounded again on 27 October 1864 at Burgess Mill, Dinwiddie, Va. He died from his wounds on 10 November 1864 in General Hospital No. 4 Richmond, Va. Burial not known at this time.

Died on January 19, 1865 at General, Hospital, Camp, Winder, Richmond City, Virginia. Only a few months before the wars end. Buried in Hollywood Cemetery Richmond, Richmond City, Virginia. Also buried in this cemetery is Jefferson Davis president of the CSA with more notables. Of course I never knew him but my heart hurts just knowing how these men suffered. On both sides.
