Teamster. Fought all battles until wounded 5/5/64 at Battle of Wilderness. Shot in jaw and out other side of face, clipping off tip of tongue. Reassigned to General Lee on 2/4/1865. With Gen. Lee till Appomattox C.H. Never paroled. Family tradition has it he evaded Union forces and walked home rather than surrender since he lived less than 10 miles from Appomattox. Was issued pension.

Enlisted 25 May, 1861, age 28, at the Floyd County Courthouse, Floyd, Va as a Confederate. About July 1862, he developed "anchylosis elbow" and declared unfit to serve so he became a nurse in 2nd Corp hospital, Dec 1863-Oct 1864. He was captured at some point and taken to Point Lookout, Md. He was released "on oath" June 19, 1865. His appearance was unrecognizable to family when he returned home. I have a tintype of him in uniform.

Enlisted as 3rd Sgt. in ('Buford Grays') Co. C, 42nd Virginia Infantry on May 18, 1861 at Lisbon, Bedford Co. At Lynchburg Hosp. by February 28, 1862 through April 1, 1862. Present August 7, 1862. Wounded at Cedar Mountain August 9, 1862. Wounded in arm & side August 29, 1862 at 2nd Manassas. At Staunton hospital through October 31, 1862. Wounded accidentally at Fredericksburg December 14, 1862. Absent but promoted to 1st Sgt. by January 15, 1863. Captured at Spotsylvania CH May 12, 1864. Held at Pt. Lookout May 18 to July 30, 1864. Held at Elmira NY August 2, 1864 to February 20, 1865 when sent to James River for exchange. His wounds prevented him from performing manual labor for some time. Applied for pension May 2, 1905; dated Circuit Court Bedford Co. June 4, 1905. At that time he lived near Thaxton. He was buried in Chilton family plot Bedford Co. ----- Film Number M382 roll 10

John Edmund Penn
- Colonel
Capt Penn commanded H Co from their formation though the Valley Campaign. After Cedar Mountain he took command of the Regiment and commanded them through 2d Manassas to Sharpsburg. The morning of 17 September after the Brigade Commander was wounded he took command of Jones' Brigade of the Stonewall Division. Later that morning he during the fighting between the West Woods and the Corn Field he was wounded and captured. He had his leg amputated and was paroled from Ft McHenry, Baltimore POW Camp. He was promoted to Major, Lt Col and Colonel with an effective date in August prior to the Battles of 2d Manassas and Sharpsburg.
