His name appears on a roll of prisoners of war at Military Prison, Louisville, Ky during 10 days ending October 10, 1863. He was sent to Camp Douglas Military Prison October 2, 1863. Received there on October 4, 1863.
He was discharged June 16, 1865.

It has been passed down through the family that my great grandfather Madison Jefferson Kilpatrick left Cherokee County, North Carolina and settled in Smith County, Texas because he did not wish to fight in the Civil War, that he did not believe what the South was fighting for. During a trip to the National Archives in Washington, D.C. I found that on June 17, 1861 he enlisted at age 16 in Company A, 29th Regiment, North Carolina Troops, also known as the 'Cherokee Guards'. The company fought at the battle of Cumberland Gap, Murfreesboro, Tenn, and Chickamauga.
The company was listed in the Confederate Roll of Honor.

John Henry Wheeler - Private

Co. B was raised in Yancey County July 3, 1861
J.H. Wheeler (son of Rev. John Wheeler and Rhoda Ray) was part Cherokee Indian (of the Red Paint Clan). On May 12, 1863 the 29th and 39th NC were transferred to Gen. Joseph E. Johnston's army in Mississippi. This unit was attached to Brig. Gen. Evander McNair's Brigade of Maj. Gen. Samuel G. French's Division (organized 21 June 1863), Gen. Joseph E. Johnston's Army of Relief (Vicksburg), Department of the West and was commanded by Lt. Col. William B. Creasman. Lt. Col. Creasman was placed in charge of the defenses of Yazoo City, MS. These troops evacuated the city on 13 July 1863. J. H. Wheeler was possibly promoted to Lt. sometime around Sept 19 and 20, 1863 at the battle of Chickamauga where the 29th lost 80 men killed and wounded and 30 missing.
He survived the war, married Sarah Duncan, and had several children, among them my GGF William Owen Wheeler (who lived and is buried in Erwin, TN)

His unit was Co C,NC 29th Infantry. James must have saw hell on earth. He fought in every major battle with his unit until he was killed in July,1864 at Kennesaw Mountain Georgia.That unit was poorly fed,clothed and equiped. Someone that was there and knew the family came by and told the family the last time he saw James he was laying across a stump(some say fence) and had been cut almost in half by a large shell.The family never knew what became with his body.

The unit was assigned the responsibility of guarding the rail roads bridges from Bristol to Chattanooga, Tennessee. On 20 February 1862, the regiment was ordered to Cumberland Gap where they were attacked by the Federal troops on 24 March. Marion Issac served until 10 April 1862, resigning as a result of poor health listed as 'chronic rheumatism'. Born 7 March 1826 near Leicester, NC, died 28 Sept. 1908, buried at Round Hill on the Ratcliff property where the family established a school 'the Ark' and Round Hill Baptist Church. Married Celia Frisbee born 26 Oct. 1828 died 22 March 1907. Letter survives that he wrote 9 November 1861 while stationed at Raleigh, NC.

His name appears on a report of officers and enlisted men at Shelbyville, Tennessee absent with leave and on detached service in McCown’s Division, Polk’s Corps, Army of Tennessee on 29 April 1863 as a teamster. He was in Breckenridge’s Division Hospital in Marion Station, Mississippi on 31 August 1863 where he died 28 November.

In his pension application he states he was 'captured and paroled' at Nicholasville, Kentucky, as the two Armies maneuvered for position before the Battle of Perryville, Ky when the Union Army evacuated Cumberland Gap.
On page two of his application there is the following :
'This application is that of an old colored man,he was there at the beginning of the war and enlisted in Captain Enlow's Company F 29th NC Troops and served in his command until Bragg's campaign in Kentucky in 1862. Captain Enlow says he was a faithful & good soldier, and he would like to see him have a pension. He is a very feeble old man and not likely to live more that a year, two at most. Captain Enlow requests a favorable response to the old fellow's situation'. Not a relative, I only honor his service
